The Law of the Land in America – 6th amendment

This is the law of the land in America.

Sixth Amendment to the organizing document of the United States of American

“In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.”

If the law does not apply to every human equally, than there is no law.

A lawless society is ruled using brute force. A few of it’s members claim for themselves special privileged status and begin to plan everyone else’s lives.

To all my friends that are afraid of free people arming themselves in defense from tyranny. Throughout the history of man governments have been created by the ruling elite class to better manage and protect their property from each other. (the peasantry)

If you think government is needed to protect you from corporate greed, please help me understand your position by answering a couple of questions for me.  Thank you for your time, please respect each other.  Personal attacks or threats of violence will be deleted.

Why does the US Federal “government” protect Monsanto from judicial oversight as we watch it pay farmers with tax dollars to spray Roundup on the land, so that the only plants that can grow are GMO crops?

Why does the US Federal “government” claim the right to kill you without trial if it feels threatened?

Why does the “government” continue to violently enforce the prohibition of beneficial plants such as Marijuana? 

I agree, society needs some institutes to protect the innocent and liberty of the people, but the people must retain the power to peacefully opt out of any “government” they know to be corrupt and working for foreign interests, and corporations are not people, so should always be considered as foreign interests.

We need to call their bluff.

The Federal Government does not have the funds to set up an exchange in each state. That is why Obamacare wants the states to do it for them. Please take action today. Call Governor Nixon and tell him to toe the line. We must not relinquish or sovereign control over our own healthcare. Caring through with the Obamacare scheme gives our consent to be governed in the most personal aspects of our lives.

This is a letter I received from Campaign for Liberty.

Dear Darrel,

Last month, you answered the call to demand our governor refuse to establish a State Health Insurance Exchange, as called for in ObamaCare.

Your quick action paid off, and the governor announced our state would not comply.

But the Department of Health and Human Services (HHS) recently extended the original deadline for submission to December 14 because some governors were still undecided on the issue.

With the amount of severe arm-twisting that goes on in politics, it is imperative we remind the governor to hold the line by continuing to say “NO!” to ObamaCare.

ObamaCare calls for a federal government-controlled online insurance “marketplace” to run mandated health insurance. That is how they can impose the “one-size-fits-all,” monopoly government-run health care system. By getting each state to implement the exchange, the federal government can implement the individual mandate to purchase insurance.

States refusing to set up their own exchange can opt for a Federal/State Partnership, and if they refuse that, HHS will set up and run a Federal Exchange in their state.

Some politicians have made claims like, “Our state has to implement this, or the federal government will impose one on us anyway.” This is a typical half-truth the liberal media lets their favorite politicians get away with.

You see, establishing a State or Federal/State Partnership Health Insurance Exchange forces the states to submit to federal regulations and they lose state sovereignty over all health care issues. The law stipulates:

“An Exchange may not establish rules that conflict with or prevent the application of regulations promulgated by the Secretary [of Health and Human Services (HHS)].”

ObamaCare provided for a limited amount of bribe money to be offered to the states to set up their exchanges, but once that money has fully dried up, the state will assume all expenses for running it.

In short, states that establish an exchange submissively relinquish sovereignty and add tens of millions of dollars a year to the state budget.

A Federal/State Partnership Exchange merely allows for the state to begin funding the exchange further down the road.

If our state refuses to go along with this scheme, the federal government can’t restrict our health care choices.

Think of it this way: if you want to get a message to someone right now, you can choose between email, social media, FedEx, UPS, or the Post Office. But with “ObamaMessage,” you would only get the Post Office. And worse yet, you would be required to pay for it whether you want it or not.

Call Governor Nixon at 573-751-3222 right away to demand he hold the line and continue to refuse to partner with the President in the takeover of your health care!

It is the governor’s responsibility under the Tenth Amendment to stand up to federal overreach and protect the citizens of our state.

Tell the governor you expect nothing less!

The 2012 NDAA claims the right to kidnap people

Del. Bob Marshall, of Virginia, called me last night. The reason will excite you. He wanted to thank me for the role DownsizeDC.org played in achieving a major victory.

Mr. Marshall’s bill, HB 1160, has passed BOTH houses of the Virginia legislature, including a 39-to-1 vote in the Senate this past Tuesday. This bill prohibits the state of Virginia from assisting the federal government in the unlawful detention of United States citizens. Remember . . .

The Executive Branch gained this power of “kidnapping” as a result of a confusing provision in the 2012 National Defense Authorization Act (NDAA). That criminal statue contained tricky language that has fooled many reporters, citizens, and even members of Congress. The measure was deceitfully written to make people think it exempts U.S. citizens when it does NOT! This linguistic deceit was likely intentional. But it’s even more important to defend the principle that citizenship is morally irrelevant, because . . .

The rights that this criminal edict violates are Pre-Constitutional. These rights must be honored for ALL people, NOT just citizens.

DownsizeDC.org has been fighting this bill since before it was enacted. Now, we are helping Delegate Marshall with a vital tactic — non-cooperation by the states!

Delegate Marshall not only thanked me for our support on the phone, he also acknowledged our help in the news release announcing this victory.

The liberty we possess as Americans is not government granted but God given. It is what our Fathers call “Our natural birthright.” Therefore, it is not ours to give away nor to relinquish; for in essence, it is given to us as caretakers for the up and coming generations of Americans yet unborn.

It is as if we are running a marathon with the baton of American liberty clutched in our hands. Our goal and our purpose is to carry it safely and pass it on to the next generation of American runners so they in turn may pass it on to the next and so forth.

But – if because we cannot see the finish line and the odds against us seem insurmountable; if we become overwhelmed and lose our will to continue the race and succumb to the temptation to sit it out; if we lose the hope in the contest and give up the race, then all is lost and American liberty is no more. The fate of future Americans is weighed in the balance and we as a free people are in charge of the outcome for no man or group of men holds in their hands the final answer to the issue but ourselves. It is up to us to run the good race and fight the good fight; we as individuals as well as we as a team, for no one person carries the American baton of liberty by themselves, we are all in this together till the end…and be assured there is no end, at least not until Providence dictates it to be so.

When in the darkest hours of the year 1772, when disunion against British tyranny seemed eminent, Warren of Plymouth was desponding and said:

“The towns are dead and cannot be raised without a miracle.”

Samuel Adams responded: “I am very sorry to find in you the least approach towards despair. Nil desperandum (never despair) is a model for you and me. All are not dead; and where there is a spark of patriotic fire, we will rekindle it.” (Bancroft”History of the United States” Vol. III pg. 426)

And indeed they did!

In late December of 1772, during that same low ebb, the Boston Committee of Correspondence wrote:

” By the people’s thorough understanding of their civil and religious rights and liberties, encouraged to trust in God that a day was hastening when the efforts of the colonists would be crowned with success, and the present generation furnish an example of public virtue worthy of imitation of all posterity.” (IBID pg. 428)

Today is that day!

Therefore, let us be a worthy example for our posterity by walking worthily of the freedom whereby we have been made free and by never returning back to the beggarly elements of slavery; for we are not children of the bond woman of old Europe but we are free born under these western skies, and free we must remain, for you are children of noble parental blood – they never quit, neither must you.

The world watches what you do here today with the greatest of anxiety for if we fail, the light of mankind’s hope for liberty and freedom will be extinguished and the world will be thrown into an age darker, sinister and more slavish than mankind has ever experienced.

Finally brethren, be not counted as the generation who lost all after it has been given all by those who gave all, for if you do, your posterity shall rise up in their slavish toil and curse you.

When a mortgage is initiated one of the first things that gets done 
is an honest appraisal is made of the value of the property.  
A loan initiator moves a line of credit with the central bank over 
to a new account in the debtor's name.  

The Debtor uses this line of credit 
to ask the bank to make new money.

An amount of new money is created equal to 
the agreed upon sale price of the property.  
The customer takes his new money 
and trades it for the property.
The seller puts the new money into his bank, 
declares his profits, 
and the bank changes the name of this new money to "deposits" 
and thus reserves for further business.

Right?

So, what if the popularly appraised value far exceeded 
the natural value of a piece of property?
Who takes the hit when these two figures correct with each other? 
(and they are in the process right now)

A)  The guy that has been paying interest payments 
for the privilege of having access to a line of credit.(99%)

B)  The institution that has been collecting and 
pocketing those interest payments all these years.(1%)

C)  Spread the loss across society via government.

The Speaker is Rep. James Traficant, Jr. (Ohio) addressing the House:

“Mr. Speaker, we are here now in chapter 11… Members of Congress are official trustees presiding over the greatest reorganization of any Bankrupt entity in world history, the U.S. Government. We are setting forth hopefully a blueprint for our future. There are some who say it is a coroner’s report that will lead to our demise.

It is an established fact that the United States Federal Government has been dissolved by the Emergency Banking Act, March 9. 1933. 48 Stat. 1. Public Law 89-719: declared by President Roosevelt, being bankrupt and insolvent. HJR 192, 73rd Congressional session, June 5, 1933 – Joint Resolution to Suspend the Gold Standard and Abrogate the Gold Clause dissolved the Sovereign Authority of the United States and the official capacities of all United States Governmental Offices, Officers, and Departments and is further evidence that the United States Federal Government exists today in name only.

The receivers of the United States Bankruptcy are the International Bankers, via the United Nations, the World Bank and the International Monetary Fund. All United States Offices, Officials, and Departments are now operating within a de facto status in name only under Emergency War Powers. With the Constitutional Republican form of Government now dissolved, the receivers of the Bankruptcy have adopted a new form of government for the United States. This new form of government is known as a Democracy, being an established Socialist/Communist order under a new governor for America. . . . Their lust is for power and control. Since the inception of central banking, they have controlled the fates of nations. . . . The Federal Reserve System is a sovereign power structure separate and distinct from the federal United States government.

. Prior to 1913, most Americans owned clear, allodia title to property, free and clear of any liens or mortgages until the Federal Reserve Act (1913) “hypothecated” all property within the federal United States to the Board of Governors of the Federal Reserve, -in which the Trustees (stockholders) held legal title. The U.S. citizen (tenant, franchisee) was registered as a “beneficiary” of the trust via his/her birth certificate. In 1933, the federal United States hypothecated all of the present and future properties, assets and labor of their “subjects,” the 14th Amendment U.S. citizen, to the Federal Reserve System.

In return, the Federal Reserve System agreed to extend the federal United States Corporation all the credit “money substitute” it needed. Like any other debtor, the federal United States government had to assign collateral and security to their creditors as a condition of the loan. Since the federal United States didn’t have any assets, they assigned the private property of their “economic slaves”, the U.S. citizens as collateral against the unplayable federal debt. They also pledged the unincorporated federal territories, national parks forests, birth certificates, and nonprofit organizations, as collateral against the federal debt. All has already been transferred as payment to the international bankers.

Unwittingly, America has returned to its pre-American Revolution, feudal roots whereby all land is held by a sovereign and the common people had no rights to hold allodia title to property. Once again, We the People are the tenants and sharecroppers renting our own property from a Sovereign in the guise of the Federal Reserve Bank. We the people have exchanged one master for another.

This has been going on for over eighty years without the “informed knowledge” of the American people, without a voice protesting loud enough. Now it’s easy to grasp why America is fundamentally bankrupt.

Why don’t more people own their properties outright?

Why are 90% of Americans mortgaged to the hilt and have little or no assets after all debts and liabilities have been paid? Why does it feel like you are working harder and harder and getting less and less?

We are reaping what has been sown, and the results of our harvest are a painful bankruptcy, and a foreclosure on American property, precious liberties, and a way of life. Few of our elected representatives in Washington, D.C. have dared to tell the truth. The federal United States is bankrupt. Our children will inherit this unpayable debt, and the tyranny to enforce paying it. America has become completely bankrupt in world leadership, financial credit and its reputation for courage, vision and human rights. This is an undeclared economic war, bankruptcy, and economic slavery of the most corrupt order! Wake up America! Take back your Country.”

In 2002, Traficant was indicted on federal corruption charges for taking campaign funds for personal use. Again, he opted to represent himself, insisting that the trial was part of a vendetta against him dating to his 1983 trial. On April 15, he was convicted of 10 felony counts including bribery, racketeering, and tax evasion. In order to get a conviction the prosecution

refused him witnesses, made deals with men who committed more serious crimes for their testimony and as one witness now admits, goaded false testimony out of their witnesses.

In March 2004, the Federal Bureau of Prisons moved Traficant to the Federal Correctional Institution, Ray Brook. As of July 2007, the Federal Bureau of Prisons listed Traficant at the Federal Medical Center, Rochester, an administrative facility providing specialized mental health services. The Ten Principles of a Free Society – discussion

The Ten Principles of a Free Society

  1. Rights belong to individuals, not groups; they derive from our nature and can neither be granted nor taken away by government.
  2. All peaceful, voluntary economic and social associations are permitted; consent is the basis of the social and economic order.
  3. Justly acquired property is privately owned by individuals and voluntary groups, and this ownership cannot be arbitrarily voided by governments.
  4. Government may not redistribute private wealth or grant special privileges to any individual or group.
  5. Individuals are responsible for their own actions; government cannot and should not protect us from ourselves.
  6. Government may not claim the monopoly over a people’s money and government’s must never engaged in official counterfeiting, even in the name of macroeconomic stability.
  7. Aggressive wars, even when called preventative, and even when they pertain only to trade relations, are forbidden.
  8. Jury nullification, that is, the right of jurors to judge the law as well as the facts, is a right of the people and the courtroom norm.
  9. All forms of involuntary servitude are prohibited, not only slavery but also conscription, forced association, and forced welfare distribution.
  10. Government must obey the law that it expects other people to obey and thereby must never use force to mold behavior, manipulate social outcomes, manage the economy, or tell other countries how to behave.

has already hit the economic ice-berg and is sinking.Arguing over who should be the next captain is not going to save us.Even if we replaced the entire leadership staff, by firing all of Congress, that also won’t save us.Those who have served in the infantry know the old saying “embrace the suck,” which means to accept reality and deal with it.Well, we need to dispense with false hope, accept that an economic collapse is coming, embrace the suck, and deal with it.As Patrick Henry said, it is better to know the worst, and provide for it, than to delude ourselves with false hope.

Frankly, we should be glad it is coming on our watch, so that we can clean up the mess we have allowed to happen, rather than leaving it to our children and grand-children to fix.As Thomas Paine said, “If there must be trouble, let it be in my day, that my child may have peace.” Exactly.This is our watch, so let’s get it done so our children and grand-children may have peace and freedom.So, knowing that the ship is sinking, what do we do?Do we sit on our butts and wail and cry about what’s coming, while waiting to hit the icy water?Do we jump into life-boats and wallow around, waiting to be rescued?That’s what the globalist power elites want us to do.When the Federal Reserve created fiat money system collapses, when the ship sinks, they will then “rescue us” by sweeping us all onboard the U.N.N. Global Leviathan – their “final solution” of a world-wide version of the “Fed” (out of the IMF) along with ‘world governance.”That has been their plan all along – con us into sailing an un-seaworthy fiat hulk, sail it into an iceberg, and then “rescue” us onto their massive prison ship.You think getting rid of the Federal Reserve is tough?Just wait till you are under a world “federal reserve.”

OPERATION SLEEPING GIANT

America’s veterans truly are like a sleeping giant. It is time to awaken them and fill them with a terrible resolve to defeat the domestic enemies of our Constitution and their globalist fellow travelers.   If we wake the veterans up, this Republic will be saved. If we don’t, then I fear that this Republic will fall.   If we can’t get the veterans to step up and do what must be done to save our Republic, then how can we expect to get the rest of our people to do what must be done?

So, let’s WAKE THEM UP so they can help us wake up the whole country and so they can take the lead in restoring this Republic and resisting the plans of the enemy.

If we reach the veterans fast and “reactivate” them, with their leadership we can get our neighborhoods, towns, counties and states squared away so we won’t be weak and desperate when the fiat money system crashes. The stronger ‘We the People’ are within our states, the less pretext there will be for “martial law” during a crisis and the less likely the current serving military and police will be to go along with it.

The following is the Introduction to Liberty Defined, Ron Paul’s newest book, to be released on April 19, 2011

America’s history and political ethos are all about liberty. The Declaration of Independence declares that life, liberty, and the pursuit of happiness are unalienable rights, but notice how both life and the pursuit of happiness also depend on liberty as a fundamental bedrock of our country.  We use the word almost as a cliche. But do we know what it means? Can we recognize it when we see it? More importantly, can we recognize the opposite of liberty when it is sold to us as a form of freedom?

Liberty means to exercise human rights in any manner a person chooses so long as it does not interfere with the exercise of the rights of others. This means, above all else, keeping government out of our lives. Only this path leads to the unleashing of human energies that build civilization, provide security, generate wealth, and protect the people from systematic rights violations. In this sense, only liberty can truly ward off tyranny, the great and eternal foe of mankind.

The definition of liberty I use is the same one that was accepted by Thomas Jefferson and his generation. It is the understanding derived from the great freedom tradition, for Jefferson himself took his understanding from John Locke (1632-1704). I use the term “liberal” without irony or contempt, for the liberal tradition in the true sense, dating from the late Middle Ages until the early part of the twentieth century,1 was devoted to freeing society from the shackles of the state. This is an agenda I embrace, and one that I believe all Americans should embrace.

To believe in liberty is not to believe in any particular social and economic outcome. It is to trust in the spontaneous order that emerges when the state does not intervene in human volition and human cooperation. It permits people to work out their problems for themselves, build lives for themselves, take risks and accept responsibility for the results, and make their own decisions.

Do our leaders in Washington believe in liberty? They sometimes say they do. I don’t think they are telling the truth. The existence of the wealth- extracting leviathan state in Washington, DC, a cartoonishly massive machinery that no one can control and yet few ever seriously challenge, a monster that is a constant presence in every aspect of our lives, is proof enough that our leaders do not believe. Neither party is truly dedicated to the classical, fundamental ideals that gave rise to the American Revolution.

Of course, the costs of this leviathan are incalculably large. The twentieth century endured two world wars, a worldwide depression, and a forty- five- year “Cold War” with two superpowers facing off with tens of thousands of intercontinental missiles armed with nuclear warheads. And yet the threat of government today, all over the world, may well present a greater danger than anything that occurred in the twentieth century. We are policed everywhere we go: work, shopping, home, and church. Nothing is private anymore: not property, not family, not even our houses of worship. We are encouraged to spy on each other and to stand passively as government agents scan us, harass us, and put us in our place day after day. If you object, you are put on a hit list. If you fight to reveal the truth, as WikiLeaks or other websites have done, you are targeted and can be crushed. Sometimes it seems like we are living in a dystopian novel like 1984 or Brave New World, complete with ever less economic freedom. Some will say that this is hyperbole; others will understand exactly what I’m talking about.

What is at stake is the American dream itself, which in turn is wrapped up with our standard of living. Too often, we underestimate what the phrase “standard of living” really means. In my mind, it deals directly with all issues that affect our material well-being, and therefore affects our outlook on life itself: whether we are hopeful or despairing, whether we expect progression or regression, whether we think our children will be better off or worse off than we are. All of these considerations go to the heart of the idea of happiness. The phrase “standard of living” comprises nearly all we expect out of life on this earth. It is, simply, how we are able to define our lives.

Our standards of living are made possible by the blessed institution of liberty. When liberty is under attack, everything we hold dear is under attack. Governments, by their very nature, notoriously compete with liberty, even when the stated purpose for establishing a particular government is to protect liberty.

Take the United States, for example. Our country was established with the greatest ideals and respect for individual freedom ever known. Yet look at where we are today: runaway spending and uncontrollable debt; a monstrous bureaucracy regulating our every move; total disregard for private property, free markets, sound money, and personal privacy; and a foreign policy of military expansionism. The restraints placed on our government in the Constitution by the Founders did not work. Powerful special interests rule, and there seems to be no way to fi ght against them. While the middle class is being destroyed, the poor suffer, the justly rich are being looted, and the unjustly rich are getting richer. The wealth of the country has fallen into the hands of a few at the expense of the many. Some say this is because of a lack of regulations on Wall Street, but that is not right. The root of this issue reaches far deeper than that.

The threat to liberty is not limited to the United States. Dollar hegemony has globalized the crisis. Nothing like this has ever happened before. All economies are interrelated and dependent on the dollar’s maintaining its value while at the same time the endless expansion of the dollar money supply is expected to bail out everyone.

This dollar globalization is made more dangerous by nearly all governments acting irresponsibly by expanding their powers and living beyond their means. Worldwide debt is a problem that will continue to grow if we continue on this path. Yet all governments, and especially ours, do not hesitate to further expand their powers at the expense of liberty in a futile effort to force an outcome of their design on us. They simply expand and plummet further into debt.

Understanding how governments always compete with liberty and destroy progress, creativity, and prosperity is crucial to our effort to reverse the course on which we find ourselves. The contest between abusive government power and individual freedom is an age- old problem. The concept of liberty, recognized as a natural right, has required thousands of years to be understood by the masses in reaction to the tyranny imposed by those whose only desire is to rule over others and live off their enslavement.

This conflict was understood by the defenders of the Roman Republic, the Israelites of the Old Testament, the rebellious barons of 1215 who demanded the right of habeas corpus, and certainly by the Founders of this country, who imagined the possibility of a society without kings and despots and thereby established a framework that has inspired liberation movements ever since. It is understood by growing numbers of Americans who are crying out for answers and demanding an end to Washington’s hegemony over the country and the world.

And yet even among the friends of liberty, many people are deceived into believing that government can make them safe from all harm, provide fairly distributed economic security, and improve individual moral behavior. If the government is granted a monopoly on the use of force to achieve these goals, history shows that that power is always abused. Every single time.

Over the centuries, progress has been made in understanding the concept of individual liberty and the need to constantly remain vigilant in order to limit government’s abuse of its powers. Though steady progress has been made, periodic setbacks and stagnations have occurred. For the past one hundred years, the United States and most of the world have witnessed a setback for the cause of liberty. Despite all the advances in technology, despite a more refi ned understanding of the rights of minorities, despite all the economic advances, the individual has far less protection against the state than a century ago.

Since the beginning of the last century, many seeds of destruction have been planted that are now maturing into a systematic assault on our freedoms. With a horrendous financial and currency crisis both upon us and looming into the future as far as the eye can see, it has become quite apparent that the national debt is unsustainable, liberty is threatened, and the people’s anger and fears are growing. Most importantly, it is now clear that government promises and panaceas are worthless. Government has once again failed and the demand for change is growing louder by the day. Just witness the dramatic back- and- forth swings of the parties in power.

The only thing that the promises of government did was to delude the people into a false sense of security. Complacency and mistrust generated a tremendous moral hazard, causing dangerous behavior by a large number of people. Self-reliance and individual responsibility were replaced by organized thugs who weaseled their way into achieving control over the process whereby the looted wealth of the country was distributed.

The choice we now face: further steps toward authoritarianism or a renewed effort in promoting the cause of liberty. There is no third option. This course must incorporate a modern and more sophisticated understanding of the magnificence of the market economy, especially the moral and practical urgency of monetary reform. The abysmal shortcomings of a government power that undermines the creative genius of free minds and private property must be fully understood.

This conflict between government and liberty, brought to a boiling point by the world’s biggest bankruptcy in history, has generated the angry protests that have spontaneously broken out around the country — and the world. The producers are rebelling and the recipients of largess are angry and restless.
The crisis demands an intellectual revolution. Fortunately, this revolution is under way, and if one earnestly looks for it, it can be found. Participation in it is open to everyone. Not only have our ideas of liberty developed over centuries, they are currently being eagerly debated, and a modern, advanced understanding of the concept is on the horizon. The Revolution is alive and well.

The idea of this book is not to provide a blueprint for the future or an all-encompassing defense of a libertarian program. What I offer here are thoughts on a series of controversial topics that tend to confuse people, and these are interpreted in light of my own experience and my thinking. I present not final answers but rather guideposts for thinking seriously about these topics. I certainly do not expect every reader to agree with my beliefs, but I do hope that I can inspire serious, fundamental, and independent- minded thinking and debate on them.

Above all, the theme is liberty. The goal is liberty. The results of liberty are all the things we love, none of which can be finally provided by government. We must have the opportunity to provide them for ourselves, as individuals, as families, as a society, and as a country. Off we go: A to Z.
